Six rules every Florida borrower should know

Payday cap $500

One deferred presentment loan at a time, $500 maximum, 7–31 day term. The state database enforces the one-loan rule; there's a 24-hour wait between loans.

Fees fixed by statute

$10 per $100 plus a $3 verification fee and $1 database fee. Every licensed lender charges the same — the difference is service.

60-day grace period

If you can't repay on the due date, tell the lender before the date and complete credit counseling within 7 days. The loan extends 60 days with no additional fees and no collections.

Pawn: 30-day grace

Florida pawnbrokers must hold a defaulted item 30 days past the due date before selling it. Redeem any time in that window for the same amount.

No criminal liability

Failing to repay a payday loan is a civil matter. Threats of arrest or criminal charges are illegal under Florida law.

Florida Office of Financial Regulation (OFR) licenses deferred presentment providers, consumer finance lenders and money services businesses. Verify any lender at flofr.gov.

A state-mandated extension on any payday loan. Tell your store before the due date and complete a credit counseling session within 7 days; the loan extends 60 days with no added fees.

How old do I need to be?

18. Bring a government-issued photo ID; for cash loans, also proof of income and an active checking account.
